All bookings will be treated as binding on the Client when confirmed in writing by Pout Models Limited by the sending of a Booking Confirmation. Pout Models Limited reserves the right to charge 50% of the total cost prior to commencement of the work.

The minimum photographic booking is 2 hours and the minimum promotional booking is 4 hours. If a day�s booking exceeds 8 hours then an overtime rate, in addition to the daily rate, will apply unless a fee has been pre-arranged with the Client. Clients must ensure that they book sufficient time for the assignment to be completed and overtime is not compulsory when requested on the day and must be agreed with the model first and cleared with the agency by telephone. We ask that staff be given two breaks of half an hour each during a normal 8 hour working day.

Should the event be cancelled due to weather conditions, the Client will be charged in the first instance 50% of the agreed fee. In the event of a 2nd cancellation the Client will be charged 100% of the agreed fee. Should the model arrive as agreed due to Client failure to cancel in sufficient time, the agreed fee will be charged in full.

Provisional bookings will be cancelled if they are not confirmed within 24 hours of the proposed booking.

Bookings cancelled within 24 hours of the start of the booking will be charged at full fee. If a booking is cancelled within 48 hours of the start time, 50% fee will be charged. For long bookings, i.e. trips, a cancellation period equal to the length of the booking must be given, otherwise the full fee will be charged.

The Client is responsible for health and safety when the model is travelling, or providing services in connection with the booking to the same extent as if the model were an employee of the Client. The Client will maintain adequate insurance cover to underwrite its obligations to the model.

The Agency is not responsible if the model fails to attend the booking. The Client is advised to insure against any loss, which might result if the model does not keep a booking because of ill health, or any other reason.

It is the Client�s responsibility to negotiate additional rates for any other usage including posters, packaging, POS display material (swing tickets, CD/video covers, show cards, web site and e-marketing). Models photographs may only be used for the above if all fees have been agreed and paid to the agency, such fees to apply to UK usage only for a period of 12 months from the date of booking. Foreign usage fees are subject to negotiation.

Unless an exclusion fee is negotiated, if a model advertises a product, he or she is entitled to work for any other competitor.

A photographer is not permitted to use experimental or test photographs for commercial purposes unless specific arrangements have been made with the agency.

Personal details of any agency model or associated persons must not be passed on to a third party.

In the event of the model or promotional staff proving unsatisfactory Pout Models Limited may reduce or cancel the charge for the time worked provided that the model or promotional staff leaves the assignment immediately and that notification is received by Pout Models Limited within 4 hours of the commencement of the assignment and confirmation of the fact is received in writing within 24 hours.

We, as the Agency, act for and on behalf of our models and promotional staff. Whilst every effort is made by Pout Models Limited to give satisfaction to the Client by ensuring a reasonable standard of skills, integrity and reliability from models and promotional staff, Pout Models Limited does not accept responsibility or liability for any loss, expense, damage or delay arising from any failure to provide any particular model or promotional staff for all or part of the period of the booking or from the negligence, dishonesty, misconduct or lack of skill of the staff provided.

In the event that the Client offers further employment to any model or promotional member of staff, other than through the Agency, then the Client shall pay Pout Models Limited a fee of �500.

Commencement of employment by a model or promotional staff for the Client is deemed acceptance of these Terms and Conditions.

All fees are to be negotiated by Pout Models Limited It is not permitted to use any photographs for any purpose whatsoever unless agreed with the Agency and all fees have been paid in full. Whilst every endeavour is made to provide a satisfactory and efficient service to the Client, we cannot be held responsible for the conduct of a model or promotional staff on an assignment. We reserve the right to negotiate within the structure of these Terms and Conditions. These Terms and Conditions are without prejudice to any claim against the Client.

As a supplier of services, these Terms and Conditions take precedence over Terms and Conditions that may be received from the Client even when those Terms and Conditions have a similar clause to this.
